Terms and Conditions of Use

Ticketing Terms and Conditions

Endemol UK Limited of Shepherds Building Central, Charecroft Way, Shepherds Bush, London, W14 0EE (“the Organiser”) are the organisers of the Dan TDM Tour (“the Tour”). These terms and conditions apply to any purchase of a ticket for a performance that is part of the Tour (“Performance”) and/or attendance at a Performance and should be read in conjunction with any terms and conditions of any Tour venue (“Venue”) and/or other ticket sales operator.

1. A ticket cannot be exchanged or refunded after purchase. Should a ticket be re-sold or transferred for profit or commercial gain by anyone other than the Organiser and/or Venue and/or ticketing operator then it will become void and the holder may be refused entry or ejected from the Venue. Tickets will only be refunded in the event of cancellation of a Performance in accordance with the terms and conditions of the relevant Venue and/or ticket sales operator. Please note that refunds will not be provided if you are not admitted to a Performance by the Venue management (e.g. if you arrive late).

2. Tickets entitle the holder to attend the Performance at the time on the date and at the Venue listed.

3. The Organiser reserves the right to alter or vary the content and timing of the Performance due to circumstances beyond their control without being obliged to refund monies or exchange tickets.

4. The Organiser reserves the right to refuse admission or to eject a ticket holder any person appearing to be intoxicated, under the influence of drugs, or otherwise behaving dangerously or inappropriately, for any other behaviour likely to cause damage, injury, nuisance and annoyance or for failure to comply with the reasonable request of the Organiser and/or the Venue and also to conduct security searches to ensure the safety of patrons

5. Neither the Organiser, Dan TDM nor the Venue operator will be responsible for any loss, damage, death or injury howsoever caused unless (i) the relevant party has breached its legal obligations; and (ii) such loss or damage is a direct and reasonably foreseeable result of the breach.  For the avoidance of doubt, the Organiser will not be responsible for the actions of any third party.

6. As filming and recording may be carried out at the Venue from time to time the ticket holder consents to being included in such films and recordings and the use, reproduction, storage, distribution and broadcasting of such films and recordings (including any copies made) worldwide in all media in perpetuity without payment.

7. It is the responsibility of the ticket holder to ascertain the date and time of any rearranged Performance date.

8. It is the responsibility of the ticket holder to check all tickets upon receipt, as mistakes cannot be rectified at a later date.

9. There is no minimum age for this Tour but given the length and content of a Performance it is not recommended for children under the age of 6. Children under this age will be admitted provided that they are in possession of a valid ticket. All children, whatever age, must have a valid ticket for the Performance in order to enter the Venue. For babes in arms, the relevant Venue terms and conditions will apply.

10. Children under the age of 16 (or under 14 for the Brighton Venue) must be accompanied by a paying adult who is aged 18 or over.

11. If you have a disability please contact the Venue regarding obtaining tickets for you and a carer. These can only be obtained from the relevant Venue box office team, not from See Tickets. Please see here for how Venues can be contacted about these tickets.

12. No photographic or recording equipment is permitted. Mobile phones and personal tablets are permitted but video recording is not permitted under any circumstances. Personal photography is allowed but not flash photography and audience members must not use tablets to take photographs as their screens will annoy and distract other members of the audience.  Selfie sticks are not permitted.  Anyone who does not comply with these video and photography restrictions may be removed from the Venue by staff.

13. Each Performance will feature lighting and video effects which may include flashing images and may involve loud noises and surprises. Each Performance will comply with generally accepted production standards for live events and should not present any great risk for people who suffer from photosensitive epilepsy, but individual circumstances vary and if this is a concern for you please contact the Venue box office for further information.

14. Tickets for Performances are issued subject to the terms and conditions of the Venues and/or SEE (as appropriate) and the rules and regulations of the Venue all of which will apply unless otherwise specified.

15. The relevant United Kingdom law will apply to these Terms and Conditions and the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to the Terms and Conditions

Diamond Minecart VIP Meet and Upgrade

16. The Diamond Minecart VIP Meet Upgrade (“the Upgrade”) is only available to those ticket holders who buy the highest tier price ticket for a Performance. Availability is limited.

17. The Upgrade includes:

Pre-show content sent by email which will only be sent by the Organiser to those ticket holders

A group chat session with other Upgrade ticket holders at the Performance

An individual photograph for each Upgrade ticket holder with Dan (one per Upgrade ticket holder) in a photo-frame created by the Organisers for the Tour.

A goody bag with some Dan TDM Tour treats including a DAN TDM Tour t-shirt created by the Organisers for the Tour.

18. Please note that for reasons of timing, the individual photograph will be taken for you by an official Tour photographer and one copy provided to the ticket holder either on the day or at a later date if it is not possible on the date. It will not be possible to take multiple selfies or have Dan sign multiple autographs.

19. Please also note that the DAN TDM Tour t-shirts will be pre-ordered so the Organisers will not be able to offer multiple sizes on the day. You will be contacted nearer the Performance date by email and asked to provide t-shirt size info.

20. All ticket holders under 16 must be accompanied by an adult to participate in the Upgrade (only one accompanying adult as space is limited). Any accompanying adult must also hold a valid ticket for the same Performance, although the accompanying adult does not need to purchase their own Upgrade (although if the adult hasn’t haven’t purchased the Upgrade they won’t receive any of the elements of the Upgrade). Very Important – any children in a group who do not have an Upgrade valid for that Performance will not be able to attend the Upgrade session.

21. The Upgrade is only available at the time of ticket purchase; it cannot be purchased later.

22. Precise details of the Upgrade including timings, will be emailed to ticket holders to the date of their Performance, around one week before the date.

23. It is expected that meet and greet sessions will take place before the Performance, so you will need to allow extra time to reach the Venue; it will not be possible to re-schedule to a later time or date if you are late.

Book – DanTDM: Trayaurus and the Enchanted Crystal

24. There is an option to upgrade to a ticket package (“the Book Upgrade”) that includes a copy of Traysaurus and the Enchanted Crystal Book (“the Book”). This is priced at £14.99 for a signed copy of the Book and £9.99 for an unsigned copy of the Book. Availability is limited.

25. You will be contacted after purchase of a Book Upgrade regarding arrangements for delivery of the Book. Books will be available for collection at the relevant Venue unless you are notified otherwise by us.

26. You will receive a confirmation of your order of the Book Upgrade package including details of what the order is comprised of, the total cost, arrangements for delivery, arrangements for cancelling your purchase, how and why you can cancel and what you would have to pay for in the event of cancellation and details of where any complaints can be directed to.

Promoter/Producer terms and conditions

There is no minimum age for this show, but given its length and content, it is not recommended for children under the age of 6. Children under this age will be admitted provided that they are in possession of a valid ticket.

Babes in arms will not be admitted; all children, whatever age, must have a valid ticket to enter the auditorium.

Any children aged 16 and under must be accompanied by an adult (aged at least 18).

No photographic or recording equipment is permitted. Mobile phones and personal tablets are permitted but video recording is not permitted under any circumstances. Personal photography is allowed, but not flash photography and audience members must not use tablets to take photographs, as their screens will annoy and distract other members of the audience. Selfie sticks are not permitted.

Anyone who does not comply with these video and photography restrictions may be removed from the venue by staff.

Once purchased, tickets cannot be exchanged or refunded; we will only offer refunds if a performance is cancelled. Please also note that refunds will not be provided if you are not admitted to a performance by the venue management (e.g. if you arrive late).

If you purchase a ticket which you subsequently find that you are unable to use, a number of reputable online services exist which may be able to help you re-sell your ticket.

Disabled customers are entitled to a carer ticket. These can only be obtained from the relevant venue box office team, not from See Tickets. Disabled customers and anyone with special access requirements are requested to contact their chosen venue box office and not to buy through See Tickets. Diamond Minecart VIP Meet and Upgrade Terms & Conditions The Diamond Minecart upgrade is only available to customers who are buying a £21 face value ticket. Availability is strictly limited.

The Diamond Minecart Experience includes:

• Exclusive pre-show content • A group chat session at the theatre, where Dan will talk through what he’s been up to and give some sneak peeks and background on the live show, including,, potentially, some time for questions. • An individual photograph with Dan (one per upgrade ticket) in an exclusive tour photo-frame. • A goody bag with some Dan TDM Tour treats including an exclusive TDM Tour t-shirt

Please note that reasons of timing, the individual photograph will be taken for you by an official event photographer. It will not be possible to take multiple selfies or have Dan sign multiple autographs.

Please also note that the exclusive Diamond Minecart t-shirts will be pre-ordered so we will not be able to offer multiple sizes on the day. You will be contacted nearer the event and asked to provide t-shirt size info.

All children must be accompanied by an adult to participate in the Diamond Minecart sessions. Any accompanying adult must also hold a valid ticket for the same performance, although the accompanying adult does not need to purchase their own upgrade (although if you haven’t purchased the upgrade, you won’t get any of the other benefits, obviously).

Very Important – any children in a group who do not have a Diamond Minecart upgrade valid for that performance will not be able to attend the Diamond Minecart session.

Also, space will be limited so only one accompanying adult will be able to join in.

The upgrade package is only available at the time of ticket purchase; it cannot be purchased later.

Precise details of the meet and greet session, including timings, will be emailed to purchasers closer to the date of their performance, around two weeks before the date.

It is expected that meet and greet sessions will take place before the performance, so you will need to allow extra time time to reach the venue; it will not be possible to re-schedule to a later time or date if you are late.

Welcome to the Dan TDM On Tour (the “Event”) website. 1. Terms and Conditions of Use:

1.1 These Terms and Conditions of Use set out important information regarding your rights, obligations and the restrictions that may apply when you use our website at the URL http://www. dantdmtour.com (the “Website”) which includes the services contained in the Website (which may include without limitation audio visual content, text, photographs, forums, chat rooms, advertising, competitions and other services) (together “Services”).

1.2 These Terms and Conditions of Use govern the relationship between you and Endemol UK Ltd. when you access and use our Services and Website. Any reference to “you” or “your”, means you as user of the Website and Services, any reference to “we”, “us”, “our” or “Endemol” is to Endemol UK Ltd. 1.3 You should read these Terms and Conditions of Use carefully before using the Website or Services. By accessing and continuing to use the Website and/or Services, you agree to be legally bound by them. If you do not agree with any of our Terms and Conditions of Use then you should not use our Services or Website.

2. Age Restrictions:

This includes the professional name, image and likeness of Dan TDM, and any elements of the Event.

4.2 You agree that you will not use the Website or the Services in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity, or cause distress, harm or inconvenience to any other person.

4.3 You will not do anything that may cause damage to the Website or the Services or our servers, systems or equipment or those of third parties, nor access or attempt to access any users’ data or penetrate or attempt to penetrate the Website security measures.

4.4 You agree to compensate us in respect of any damages or losses suffered by us as a result of any claim or legal action brought against us by any third party in respect of any matter arising from your use of the Services in breach of these Terms and Conditions of Use or from your violation of any applicable law or regulation.

4.5 You agree not to give any indication that you have any commercial relationship with us, or that you are our agent or that we have endorsed any User Content you may make.

4.6 We reserve the right to suspend, restrict or terminate your access to any, or all, of the Website and/or the Services at any time at our sole discretion.

4.7 We may also ban or suspend you (at our discretion) as a user of the Website and the Services if you do not comply with these Terms and Conditions of Use.

5. Intellectual Property:

5.1 All intellectual property rights in the Website (including but not limited to the design, arrangement and look and feel of the Website) and all material or content made available by us and/or our partners via the Services (excluding any User Content (in respect of which see paragraph 11 below)) shall remain at all times the property of Endemol or Endemol’s licensors.

5.2 The names, images and logos identifying us, companies in the Endemol group, our partners or third parties and our/their products and services contained in the Services are proprietary marks and may not be reproduced or otherwise used without express permission.

5.3 Nothing contained in these Terms and Conditions of Use shall be construed as conferring by implication any licence or right to use any trade mark, patent, design right or copyright of Endemol or of any third party.

6. Piracy:

6.1 Certain of our Services use security technology to protect the material and content made available on our Services. You may not attempt to, or assist, any other person to remove or otherwise alter or interfere with any security technology used in connection with the Services, nor may you permit or assist in any way any third party to use the material or content made available by us via the Services in an unlawful manner or in a manner which could infringe the rights of, or restrict or inhibit the use and enjoyment of the Services by, any third party.

7. Registration and Passwords:

7.1 Registration is not required to browse the Website. However, you may be required to register your details for certain Services (for example, to register for a newsletter or to participate in special promotions) and open a user account that you can then use to access and log on to use those Services. 9.2 If you decide to visit any linked website you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other items of a potentially destructive nature which they may contain and to comply with the terms and conditions of the relevant website (including without limitation any age restrictions). We will not be responsible for or liable for any content, advertising, products, services or information on or available from any third party website or material (including payment for and delivery of such products or services) or for any damage, loss or offence caused by or, in connection with, the same. Any terms, conditions, warranties or representations associated with such dealings, are solely between you and the provider of the relevant service.

9.3 You agree that we will not be party to any transaction or contract with a third party that you may enter into and we will not be liable to you for any loss or damage which you may suffer by using any third party websites and services. 10.7 Nothing in these Terms and Conditions of Use will restrict your statutory rights as a consumer or limit our liability for death or personal injury resulting directly from our negligence or for fraud.

11. Your Submissions:

11.1 If you wish to submit any contribution to the Services and/or upload any content on the Website, such as any text, photographs, graphics, video, audio, and competition entries (including without limitation messages, comments and/or blogs for the webchat or for the forum (if a forum is available) or any material for potential use in connection with the Event itself) (together “User Content”), you agree that any such User Content is subject to these Terms and Conditions of Use and in particular to the following terms:

11.1.1 You promise that you are the original owner of any User Content you contribute or that you have the necessary licences, rights, consents, and permissions to authorise us to use your User Content on the Website and Services and in accordance with 11.1.2 below. In particular, you promise that you are the copyright owner of any User Content you contribute (or are validly authorised by the copyright owner to make the relevant use of the material forming such User Content) and have obtained the permission of all of the people featured or referred to in such User Content (and if they are under 18 their parents or guardians as well) to include them in such User Content and to allow the use by us of your User Content on the Website and Services and in accordance with 11.1.2 below. You agree to give us evidence of all such licences, rights, consents, and permissions immediately on request by us. You acknowledge that the contents of any User Content which you choose to place on the Website will be considered non-confidential.

11.1.2 By submitting User Content, you grant us a worldwide, perpetual, non-exclusive, royalty-free and transferable licence (with the right to sub-license) to use, edit, reproduce, record, modify, translate, distribute, play, perform, and otherwise make available (including to other users), prepare derivative works of and to include your User Content on the Website and/or Services and/or as part of any other work (including without limitation as part of any of our and our partners’ profiles on third party platforms such as Twitter and Facebook and/or as part of the Event itself) in any and all media and by any method whether now known or later developed throughout the world for the full term of copyright and any other rights and all renewals revivals and extensions thereof. You also agree to waive your moral rights in your User Content. You understand and agree that once you submit User Content we shall be unable to modify or remove it from the Website or Services or such other work (including the Event).

11.2 You are responsible for the contents of any User Content you make and the consequences arising from its use on our Services. (Please note that we cannot accept any User Content containing any music, save where expressly permitted by us.) You agree that you will not upload to the Website any material or content which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or infringes the rights of a third party or may have the effect of being insulting, harassing, threatening, abusive or hateful or which otherwise degrades or may be seen to intimidate an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability. You agree not to infringe any laws in order to produce or submit any User Content. You agree not to transfer files which contain viruses or other harmful programs. Further, you must not endanger yourself or others, take any unnecessary risks in order to produce or make available any User Content.

11.3 You also agree not to advertise or promote third parties’ or your own goods or services on or by means of the Website or your User Content including by way of the distribution of “spam” email. In particular, you agree not to use the Services to provide links to third party websites. We do not guarantee or endorse any User Content or opinion, recommendation or advice posted on the Website by users, and we expressly disclaim any and all liability in connection with such material.

11.4 We may accept your User Content, modify your User Content, or refuse to display your User Content at any time in our sole and absolute discretion. We may also withdraw your User Content and/or suspend, restrict and/or terminate the Services provided under these Terms and Conditions of Use immediately without notice to you for any reason, including, without limitation, where we suspect your User Content to be in any way defamatory, obscene, unlawful, harmful, insulting, offensive, inappropriate or to infringe the rights of a third party. 14 Law and Jurisdiction:

14.1 These terms shall be governed by and interpreted in accordance with the laws of England and Wales and the English Courts shall have exclusive jurisdiction over any disputes.

15 Other Terms and Conditions:

You may be asked to agree to further terms and conditions when using specific Services (for example entering competitions promoted by us, or by our partners on the Website, submitting materials, or when subscribing to a newsletter). If there is any inconsistency between these Terms and Conditions of Use and any such terms and conditions, the latter terms and conditions shall prevail.

16.1 These Terms and Conditions of Use were last updated on 19 April 2016. Please note that we may update and amend these Terms and Conditions of Use from time to time and any changes will be posted on the Website. However, it is your responsibility to ensure you review these Terms and Conditions of Use regularly to familiarise yourself with any changes. We will not file or store a copy of these terms for each transaction by you via the Website. We therefore recommend that you print and store or save a copy of these Terms and Conditions of Use for future reference.
